Article 1 - Applicability.

1.1 These general terms and conditions of Altijd Door B.V. / Feel The Rhythm Festival (hereinafter referred to as: general terms and conditions) apply to every offer and every agreement that comes about between Altijd Door B.V. / Feel The Rhythm Festival and the person who orders, buys and/or attends an event organised by Altijd Door B.V. / Feel The Rhythm Festival. The general terms and conditions also apply to the activities of all natural persons and legal entities affiliated to Altijd Door B.V. / Feel The Rhythm Festival and all other natural persons and legal entities, auxiliary persons and employees engaged by Altijd Door B.V. / Feel The Rhythm Festival.

1.2 For the purposes of these general terms and conditions, an event means a bmx race, (music) performance or festival in the broadest sense of the word for one or more days, organized by Altijd Door B.V. / Feel The Rhythm Festival or a third party that Altijd Door B.V. / Feel The Rhythm Festival has engaged for the organization and execution thereof and ticket sales.

1.3 Before the distance agreement is concluded electronically, the text of these general terms and conditions will be made available electronically to the person ordering an admission ticket and made available in such a way that he/she can easily take cognizance of its contents. On the website of Altijd Door B.V. / Feel The Rhythm Festival, before the remote agreement is concluded, it will be possible to become familiar with the content of these general terms and conditions and to save them in a simple manner on a durable data carrier or to print them out. Only after the person wishing to order/purchase an admission ticket has expressly agreed to the applicability of the general terms and conditions of Altijd Door B.V. / Feel The Rhythm Festival can the actual purchase of admission tickets be proceeded with.

1.4 These general terms and conditions apply to all persons attending the event organized by Altijd Door B.V. / Feel The Rhythm Festival and involved in this directly or indirectly by ordering tickets sold by Altijd Door B.V. / Feel The Rhythm Festival.

1.5 The applicability of any other general terms and conditions is expressly rejected.

Article 2 - Tickets.

2.1 An agreement is reached with Altijd Door B.V. / Feel The Rhythm Festival as soon as the person who wishes to order and purchase an admission ticket clicks on the order button on the relevant website. The person is then obliged to pay (via I-deal) for the tickets ordered and Altijd Door B.V. / Feel The Rhythm Festival is obliged to send the tickets after receipt of payment.

2.2 Paid tickets will be sent within 14 days after receipt of payment by e-mail or by post, depending on the type of ticket and event. When sent by post, Altijd Door B.V. / Feel The Rhythm Festival will never be liable for tickets getting lost or not arriving.

2.3 A ticket consists of a document provided by or on behalf of Altijd Door B.V. / Feel The Rhythm Festival or an e-mail with a barcode. The barcode is unique. The ticket is issued once and gives access to one person. An entry ticket only gives access to public areas on the festival grounds, therefore not to sponsor or VIP areas, paddock, backstage areas, etc. Only holders of a camping ticket have access to the camping area.

2.4 If the order is not completed within 10 minutes, he/she will be given the opportunity to still complete the payment within 1 hour. For this purpose, he/she will receive an e-mail with a reminder and a link to the payment site. If the payment is not completed within 1 hour, the agreement will be considered as non-fulfillment and will be dissolved by Altijd Door B.V. / Feel The Rhythm Festival without further notice.

2.5 For payments from abroad, the time limit mentioned in paragraph 4 of this article is 120 hours instead of 1 hour.

2.6 The risk of loss or damage to tickets lies with the person who has purchased an admission ticket. Invalid tickets may be refused by Altijd Door B.V. / Feel The Rhythm Festival without any claim to a refund of the purchase price.

2.7 The tickets received may not be reproduced or resold or transferred to third parties. If these provisions are violated, he/she shall owe an immediately payable fine to Altijd Door B.V. / Feel The Rhythm Festival in the amount of € 5,000. Furthermore, he/she will be denied access to the event by the event organizer and the relevant tickets will be rendered invalid. The visitor will not be entitled to any refund or compensation.

2.8 If tickets are duplicated in any way and multiple tickets with the same barcode are presented at the entrance check to an event, Altijd Door B.V. / Feel The Rhythm Festival or the organizer of the event has the right to determine that the person who shows the ticket first at the start of the event is the person entitled to access to it.

2.9 Altijd Door B.V. / Feel The Rhythm Festival has the right to invalidate the ticket(s) or deny the visitor access to the event (by the organizer of the event) if and as soon as one or more of the provisions contained in these general terms and conditions are violated. If so, the visitor will not be entitled to a refund or compensation.

Article 3 - Other obligations visitors

3.1 Visitors to the event organized by Altijd Door B.V. / Feel The Rhythm Festival must comply with the provisions contained in these general terms and conditions as well as the separate regulations for the benefit of the races and the campsite, namely: "campsite house rules". Dutch law is in force on the festival grounds.

3.2 To protect the safety of event visitors, they are required to identify themselves and may be searched (including inspection of bags/backpacks carried). Failure to cooperate may result in denial of access to the festival by the event organizer.

3.3 It is not allowed to bring (seating) furniture, coolers and/or your own food (including packed lunches) and drinks inside the festival grounds. Obviously, this does not include specific diet food on doctor's prescription (e.g. gluten-free etc.) and wheelchairs/scootmobiles. Umbrellas are also not allowed for safety reasons. (Pets) are not allowed (for their own good). Assistance dogs are of course allowed access.

3.4 Visitors dressed in club clothing and/or clothing belonging to (a) particular group(s) may be refused.

3.5 Film, video and professional photography equipment (cameras with large interchangeable lenses) and drones are not allowed, unless explicitly authorized by the organization in advance (e.g. for press). Cell phones with photo/video capabilities and normal (digital) cameras without detachable lenses are allowed on the festival grounds.

3.6 Distribution of leaflets, flyers and/or trading in goods on the festival and in the immediate vicinity is prohibited unless written permission has been granted by Altijd Door B.V. / Feel The Rhythm Festival or the organization.

3.7 Alcohol will not be provided to persons under the age of 18 (either directly or by resupply). Persons apparently under the influence of alcohol and/or drugs may be refused entry to the festival grounds. The person demonstrably under the influence cannot claim any reimbursement of admission tickets, travel expenses and/or any other costs incurred.

3.8 Smoking is not permitted in festival tents and other enclosed festival areas. Altijd Door B.V. / Feel The Rhythm Festival may be fined by the NVWA for this. If the event organizer discovers that this provision has been violated, the visitor will be required to extinguish smoking materials immediately and cease using them. Failure to do so may result in denial of further access to the festival by the event organizer. Any fines referred to above will also be recovered from the offender. Outside the festival grounds, it is not allowed to throw away burning smoking materials, partly due to the danger of fire. These must be completely extinguished in all cases. Visitors must respect nature and the environment. Drugs are prohibited on the festival grounds. Upon discovery of the use and/or possession of soft/hard drugs and/or dealing soft/hard drugs, the person in question will be arrested immediately and handed over to the police.

3.9 Upon detection of the commission of crimes, pollution and/or destruction of nature, environment, materials and grounds, further access to the festival site will be denied and the person may be handed over to the police. Also, any damages will be recovered from the person causing the damage.

3.10 The possession of weapons or other objects that can be used as weapons is prohibited. Upon detection, the person will be turned over to the police.

3.11 Anyone attending the event organized by Altijd Door B.V. / Feel The Rhythm Festival agrees to recordings being made. In case of emergencies, these recordings may be shown to government authorities as supporting material. During the festival photographs and video recordings will also be made for promotional purposes. Everyone who visits an event organized by Altijd Door B.V. / Feel The Rhythm Festival agrees to this.

3.12 In all situations where the general conditions, regulations and house rules do not provide, Altijd Door B.V. / Feel The Rhythm Festival and/or the organization will decide. Instructions from employees of the organization or authorized persons appointed for this purpose must be followed at all times.

Article 4 - Payment and prices

4.1 Ticket prices are those in effect at the time of the order and include VAT and other taxes imposed by the government.

4.2 Payment for admission tickets must be made directly at the time of ordering via the payment methods indicated by Altijd Door B.V. / Feel The Rhythm Festival, such as iDEAL, credit card or other approved payment methods.

4.3 It is not possible to exchange or cancel admission tickets after purchase, unless otherwise stated in these terms and conditions or by Altijd Door B.V. / Feel The Rhythm Festival at the time of purchase.

4.4 If problems arise with the payment of a ticket, Altijd Door B.V. / Feel The Rhythm Festival will inform the visitor via email and, if applicable, suggest an alternative payment method.

4.5 Always By B.V. / Feel The Rhythm Festival reserves the right to change ticket prices even after an order has been placed, provided that the change applies to future orders and no payment has been made.

Article 5 - Cancellation, modification and reimbursement.

5.1 The cancellation or modification of a ticket order is in principle not possible, unless Altijd Door B.V. / Feel The Rhythm Festival has explicitly authorized the cancellation or modification or when the law grants such rights.

5.2 If an event is cancelled by Altijd Door B.V. / Feel The Rhythm Festival or due to force majeure (as described in Article 6), the customer will be entitled to a refund of the ticket purchase price, or any other appropriate arrangement offered by Altijd Door B.V. / Feel The Rhythm Festival, such as a replacement event or voucher.

5.3 The right to a refund expires if the customer sells or otherwise transfers his admission ticket to a third party without the consent of Altijd Door B.V. / Feel The Rhythm Festival.

5.4 Any refunds will only be made through the original payment method and may take several business days, depending on the payment provider's processing time.

Article 6 - Force majeure

6.1 In the event of force majeure, Altijd Door B.V. / Feel The Rhythm Festival shall not be obliged to fulfill its obligations under this agreement, unless the force majeure is of such a nature that fulfillment of the obligation within a reasonable time is possible.

6.2 Force majeure includes, but is not limited to, circumstances such as natural disasters, war, terrorist attacks, strikes, government measures, fire, illness, pandemics, transportation problems and other unforeseen circumstances beyond the control of Altijd Door B.V. / Feel The Rhythm Festival.

6.3 If the event for which tickets have been purchased cannot take place due to force majeure, Altijd Door B.V. / Feel The Rhythm Festival will make every effort to offer alternative dates or a substitute event. If this is not possible, Altijd Door B.V. / Feel The Rhythm Festival will, at its discretion, offer a partial or full refund to ticket purchasers.

6.4 Always By B.V. / Feel The Rhythm Festival shall not be liable for any loss, damage or expense resulting from force majeure.

Article 7 - Liability

7.1 Altijd Door B.V. / Feel The Rhythm Festival is not liable for damage to persons, property or other items resulting from attendance at the event unless the damage is the result of intent or gross negligence on the part of Altijd Door B.V. / Feel The Rhythm Festival.

7.2 Always By B.V. / Feel The Rhythm Festival is not liable for loss or theft of personal property during the event.

7.3 Visitors are responsible for obtaining appropriate insurance for property damage, injury or other accidents that may occur during the event.

Article 8 - Data protection

8.1 Always By B.V. / Feel The Rhythm Festival respects the privacy of visitors and ensures that personal data is processed securely in accordance with applicable privacy and data protection legislation.

8.2 Data collected during the ordering process or while visiting the event may be used for providing information about the event, sending newsletters and handling customer inquiries.

8.3 Visitors may unsubscribe from newsletters or other communications from Altijd Door B.V. / Feel The Rhythm Festival at any time by adjusting their preferences in their profile or by submitting a request via the contact methods indicated.

Article 9 - Applicable law and disputes.

9.1 These general terms and conditions and all agreements between Altijd Door B.V. / Feel The Rhythm Festival and its visitors are governed exclusively by Dutch law.

9.2 All disputes arising out of or in connection with these general terms and conditions or the performance of the agreement shall be submitted exclusively to the competent court in the district where Altijd Door B.V. / Feel The Rhythm Festival is located, unless otherwise required by mandatory law.

Article 10 - Final provisions

10.1 Always By B.V. / Feel The Rhythm Festival is entitled to amend these terms and conditions. Changes will be published on the event website and are effective from the time of publication, unless otherwise indicated.

10.2 If any provision of these General Terms and Conditions is found to be invalid, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that corresponds as closely as possible to the intent of the original provision.
